Abstract

A division bench of the Hon’ble Bombay High Court was hearing a petition filed by an owner of a building relating to the issue of proposed redevelopment, who had suggested complete reconstruction of the structure while on the other hand, the tenants were of the view that carrying out repairs to the building would be enough. The bench while pronouncing its order, upheld the importance of the landowners rights in the matter of redevelopment and cancelled the repair NOC issued by the MCGM to the tenants for the purpose of carrying out structural repairs to the building.
